Everything Changed Since May 2025

If you have been living in Fuengirola in an irregular situation and are thinking about regularizing your status, there is very important news: social rooting has changed substantially since May 20, 2025. Royal Decree 1155/2024, which entered into force on May 20, 2025, has completely reformed the Immigration Regulations. One of the most significant changes is that the general requirement for continuous stay in Spain is reduced from 3 to 2 years. If your information comes from before May 2025, it is outdated. In this guide we explain exactly how social rooting works under the new regulatory framework of 2026.

What Social Rooting Is in 2026

The new Regulations expand social rooting to two situations: with family ties to legal residents (spouse, registered partner, ascendants or descendants in the first degree), or without ties but with a social integration report from the Regional Government. The second scenario is the most common in Fuengirola: people who have lived integrated in the community for years, presenting the integration report as proof of their real roots.

The Most Important Changes Since May 2025

The time of stay has been reduced from 3 to 2 years. This is the most significant change: with two years of documented residence, you can submit your application. The report is no longer issued by the Town Hall but by the Regional Government. This change creates confusion: the social integration report is now issued by the Regional Government's Delegation in Malaga, not the Town Hall's Social Services. The requirement for financial means of 100% of the IPREM (€630 per month in 2026) is maintained. New 'second chance rooting' modality for people who have lost their legal residence in the two previous years. These changes make social rooting more accessible than ever.

Complete Requirements for Social Rooting in 2026

Continuous stay of at least 2 years. Absences cannot exceed 90 days. Proven with historical registration certificate, medical records, school enrollments, bank statements or utility bills. Social integration report from the Regional Government (issued by the Regional Government's Delegation in Malaga) or documented family ties. No criminal record in Spain or countries of residence in the last 5 years. Financial means of 100% of monthly IPREM (€630 in 2026). Not being an applicant for international protection at the time of application. These requirements are more accessible than before thanks to the reduction from 3 to 2 years of stay.

Required Documentation in 2026

The EX-10 form properly completed, which must be submitted electronically. Valid complete passport with all pages. Historical registration certificate less than three months old. Supporting documentation of stay (lease contracts, receipts, bank statements, medical records). Spanish criminal record certificate less than three months old. Criminal record certificate from country of origin apostilled and translated to Spanish. Social integration report issued by the Andalusian Regional Government. Documentation of financial means (employment contract, bank statements, etc.). Proof of payment of tax 790 code 052. The documentation is extensive but all these proofs are necessary to demonstrate compliance with requirements under the new Regulations.

Where It Is Processed in Fuengirola in 2026

The social integration report is now from the Regional Government. This change is crucial: the report is issued by the Regional Government's Delegation in Malaga, not by the Town Hall. You must contact the Regional Government Department to request the social integration assessment. The rooting application is submitted electronically. You can submit it through the Mercurio platform, in person at the Malaga Immigration Office, or through a lawyer's representation. The Immigration Office is located at Mauricio Moro Pareto Street number 2, Malaga. This change in procedure is one of the most frequent errors in 2026: many people still look for the report at Town Hall when the correct process is through the Regional Government.

Real Timelines in 2026

The legal deadline is three months from the submission of a complete application. In practice, the Malaga Immigration Office is resolving these cases between the fourth and seventh month for well-documented cases. If there is a correction request, the deadline is suspended and resumes when you submit the requested documents, which can extend the process to nine or twelve months. These timelines are shorter than before thanks to the reduction from 3 to 2 years of stay, which simplifies document evidence.

Most Common Mistakes in 2026

Error number one: still requesting the report from Town Hall when it should be requested from the Regional Government. This causes significant delays. Error number two: submitting with information from old regulations thinking three years are needed. With two years you can already do it. Error number three: not apostilling the criminal record certificate from your country of origin. This automatically rejects the case. Error number four: submitting registration or criminal record certificates older than three months. Error number five: not including documentation of financial means of 100% IPREM. Error number six: not properly managing complementary residence documentation. These errors are avoided with specialized advice.

Social Rooting vs Socio-Professional Rooting in 2026

With the reform of RD 1155/2024, socio-professional rooting replaces employment rooting with more flexible requirements. If you have two years of stay and a work contract of at least 20 hours per week, socio-professional rooting can be faster than social rooting because it does not require the integration report. If you have two years of stay but do not have a work contract, social rooting with an integration report is your route. At Hispamar we analyze your case for free and recommend which of the two routes is best for you.
