Recovery of Spanish nationality: who can apply and how it works

Who may recover it

Recovery is intended for people who were Spanish and lost that status in certain circumstances, for example by not declaring in time their wish to retain it or by acquiring another nationality in specific cases.

This is not a first-time acquisition, but rather the rebuilding of the registry and legal link with Spanish nationality based on previous records.

Residence requirement and process

As a rule, legal residence in Spain is required at the time of application, except in cases where an exemption is expressly provided. The application is submitted before the Civil Registry corresponding to the applicant's address.

Tests such as DELE or CCSE are usually not required if the person previously held Spanish nationality, although each case should still be reviewed individually.

Usual documentation

It is usually necessary to provide the full Spanish birth certificate, documents explaining the reason for the loss, local registration, a valid passport and criminal or residence certificates depending on the history of the case.

Document check before applying for nationality

In Spanish nationality files, the most common errors involve expired certificates, criminal-record documents without legalization, name discrepancies, gaps in residence continuity or poorly documented integration evidence.

Before filing, it is worth reviewing residence-card history, departures from Spain, local registration, civil certificates and criminal-record status. A prior review helps avoid a file being delayed for months by a foreseeable correction.

Case monitoring and incident response

Filing is not the end of the work. Notifications, status changes, requests and possible delays must be monitored. If the Administration asks for additional information, the response should follow the same document logic as the initial application.

When the decision is favorable, practical steps remain: oath or promise, civil-registry registration where applicable and obtaining the Spanish DNI and passport. Planning this stage helps avoid missed appointments and unnecessary delays.
